Market Rent Only, go free of tie public house.
The Pubs Code etc. Regulations 2016 was passed and implemented in July 2016 as a means to create a transparent relationship between pub companies and their tied tenants. A tied tenant must buy tied products from their pub company. The Pubs Code allows for tied tenants to take a Free Of Tie rent option at rent review, lease renewal or at certain ‘trigger’ points. However, the code only applies for pub companies which own over 500 pubs, these being:
- Greene King
- Marston’s
- Star Pubs & Bars
- Admiral Taverns
- Punch Taverns
- Enterprise Inns
Concerned the pub’s code is being breached?
The Pubs Code etc. Regulations 2016 covers many day to day aspects of the relationship with your pub company.
Typically, pub tenants and lessees have little more than a nagging feeling something is wrong or that they are being treated unfairly.
If things are going wrong, how will you know if they are code breaches and what can be done about it? Are there things your pub company does that you would like to stop?
